NOTICE OF SEIZURE & INTENDED FORFEITURE

THE STATE OF OKLAHOMA TO:Anyone claiming an interest in the currency described herein. You are hereby notified the State of Oklahoma has seized and intends to forfeit the following:
FORTY-TWO THOUSAND FIVE HUNDRED NINETY-ONE DOLLARS
($42,591.00) IN U.S. CURRENCY

The currency was used in Garvin County, State of Oklahoma during a violation of the Uniform Controlled Dangerous Substances Act, hereinafter the Act, Okla. Stat. tit. 63, §§ 2-101, et seq., on or about August 4, 2025, when Hector Gamino (Gamino) and Guillermo Jesus Limon (Limon) transported $42,591 in U.S. currency which Oklahoma Highway Patrol Trooper Joan Alvarez (Alvarez) had probable cause to believe was proceeds from illegal drug activity. Alvarez was traveling northbound on Interstate 35 when he observed a vehicle followingly too closely at 75-mph. As he got closer to the vehicle, it braked hard, and he activated his emergency lights to conduct a traffic stop. The vehicle pulled to the shoulder and came to a stop. Alvarez made a passenger side approach, greeted the 2 occupants, and asked for the drivers documentation. He explained the reason for the stop. As he stood at the window, he smelled the odor of raw marijuana coming from the vehicle. The driver handed Alvarez a Texas drivers license identifying him as Gamino. Alvarez asked him to have a seat in his patrol unit while he conducted his enforcement action, and Gamino complied.
As the two were seated in Alvarezs unit, Alvarez began running his standard law enforcement checks while engaging in casual conversation with Gamino. He learned the two were headed to Oklahoma City from Dallas to visit people for a few days. As he drafted a warning for the traffic infraction, he observed Gaminos body language and noticed his pulse was beating heavily in his abdominal area. Alvarez thought this was odd since he had explained to Gamino he was just getting a warning. After handing the warning to Gamino, Alvarez explained that he had smelled the odor of raw marijuana coming from the vehicle and he would be conducting a probable cause search. (Based on Alvarezs training and experience in drug interdictions, he knows people routinely come from Texas to Oklahoma to purchase black market marijuana.) He asked if the two had any large amounts of U.S. currency in the vehicle, and Gamino said no. Alvarez conducted a weapons pat down on Gamino and then had him remain in his patrol unit.
Alvarez approached the parties vehicle and asked the passenger (identified as Limon) to exit and stand off to the side while he conducted a search. Under the front passenger seat, Alvarez found a plastic sack containing rubber-banded bundles of U.S. currency. He then opened the glove compartment and found another plastic sack containing more rubber-banded bundles of U.S. currency. Suspecting the parties had drug proceeds, he detained both in handcuffs and continued the search. The vehicle was completely empty, meaning the parties had no luggage for their alleged multi-day trip to Oklahoma City. Alvarez then had Limon sit in his unit with Gamino, at which time Limon told Gamino the two should have stopped at the casino first. Limon told Alvarez the money is closer to $30,000. Alvarez then separated the two to ask them about the currency.
When Alvarez asked Gamino about the currency, he said he was a business owner, and the currency was over $20,000. However, he was unable to provide a specific dollar amount and could only say it was over $20,000. Alvarez looked at the currency and noted it consisted of multiple denominations and was held together with rubber bands, something he knows to be consistent with drug proceeds. Alvarez informed Gamino he would be seizing the currency and their cell phones. He then spoke to Limon about the currency and was told by Limon that the parties were professional gamblers and were coming to Oklahoma City to gamble. He told Alvarez the two had about $41,000. Alvarez returned to his unit and noticed that Gamino had grabbed his phone and was attempting to conceal it. Alvarez took it from him and placed it on the dashboard. Both parties were given a Confiscated Property Receipt for their phones and the currency and were released from the scene. The currency was transported to Troop SO headquarters in Oklahoma City, where Trooper Francisco Valdez deployed his CLEET-certified drug canine for a free air sniff of the area. Valdez informed Alvarez his canine gave a positive alert and indication to the odor of narcotics coming from the currency. A count of the currency showed a total of $42,591 was seized.
The currency is subject to forfeiture as monies used and/or intended to be used to facilitate a violation of the Act pursuant to 63 O.S. § 2-503(A)(6). The owner, claimant, or any other party claiming an interest may file a Verified Answer to the Notice of Seizure and Intended Forfeiture within forty-five (45) days after the mailing, publication, or delivery of this Notice after which time the State of Oklahoma shall move this Court for an Order of Forfeiture of the currency in compliance with Okla. Stat. tit. 63 §§ 2-503 and 2-506.
